These Terms of Use (“Terms”) govern your use of thetidalhouse.com and related pages operated by Tidal House (the “Site”). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
1. About the Site
The Site provides information about Tidal House, its chalets, amenities, local activities, and availability. It also links to a secure third-party booking service operated by Hostfully. The Site is intended for people who are at least 18 years old and able to enter a binding agreement.
2. Reservations and Booking Terms
A reservation is not confirmed merely by viewing availability, submitting a search, or beginning checkout. A reservation becomes binding only when the booking service confirms it and any required payment or authorization is completed.
Hostfully shows the current rate, taxes and fees, payment schedule, cancellation policy, occupancy limits, house rules, and applicable rental terms during checkout. You must review and accept the terms shown for the specific chalet and dates before completing a reservation. Those reservation-specific terms, together with these Terms, govern your booking. If they conflict, the reservation-specific terms control for the reservation.
Prices and availability can change until a reservation is confirmed. Third-party booking channels such as Airbnb or Vrbo may impose their own terms and policies when you book through them.
3. Accurate Information
You agree to provide accurate, current, and complete information when contacting us or making a reservation. You are responsible for activity undertaken through your reservation and for ensuring that all members of your party understand the applicable occupancy limits, property rules, and safety information.
4. Permitted Use
You may use the Site for personal, lawful travel planning and booking. You may not:
- interfere with the Site’s operation, security, or access controls;
- use automated tools to scrape, overload, or probe the Site except as permitted by law or our written authorization;
- submit false, fraudulent, abusive, or unlawful information;
- copy, republish, or commercially exploit Site content without permission; or
- use the Site in a way that infringes another person’s rights.
5. Content and Intellectual Property
The Site and its text, photography, graphics, logos, design, and other content are owned by Tidal House or used with permission and are protected by applicable intellectual-property laws. We grant you a limited, revocable, nonexclusive right to access and use the Site for its intended purpose. No other rights are granted.
6. Local Information and Third-Party Links
We work to keep lodging, event, restaurant, attraction, beach, tide, and other local information useful and current, but conditions, schedules, prices, rules, and availability can change. Verify time-sensitive information with the relevant operator or authority before relying on it.
The Site links to services and websites we do not control, including Hostfully and local businesses. We are not responsible for third-party content, availability, privacy practices, security, or terms. A link does not necessarily imply endorsement.
7. Disclaimers
To the fullest extent permitted by law, the Site is provided “as is” and “as available.” We do not warrant that it will be uninterrupted, error-free, or free of harmful components, or that all content will always be complete or current. Nothing in these Terms excludes a warranty or right that cannot lawfully be excluded.
8. Limitation of Liability
To the fullest extent permitted by law, Tidal House and its owners, personnel, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of the Site. Our total liability arising from the Site will not exceed the greater of $100 or the amount you paid directly for use of the Site. This section does not limit liability that cannot lawfully be limited, and reservation-specific obligations remain governed by the terms accepted during booking.
9. Indemnity
To the extent permitted by law, you agree to indemnify and hold Tidal House harmless from third-party claims, losses, and reasonable costs arising from your unlawful misuse of the Site or violation of these Terms. This does not apply to the extent a claim results from Tidal House’s own conduct.

11. Tidal House Text Messaging Terms
The Tidal House text messaging program provides messages to people who have consented to receive them. Depending on the consent you provide, messages may include reservation confirmations, check-in information, guest-service responses, safety or stay-related updates, and separately authorized promotional messages. You may opt in only through a Tidal House or reservation workflow that presents the applicable SMS disclosure, or by initiating a text conversation with us and requesting a response. Consent is voluntary and is not a condition of making a purchase or reservation.
Message frequency varies according to your reservation, requests, and the messaging program you selected. Message and data rates may apply. Your wireless carrier’s terms and charges apply.
Reply STOP to cancel and stop Tidal House text messages. We may send one final opt-out confirmation. Reply HELP for help, email [email protected], or call 360-525-3357. If you change or deactivate your mobile number, please notify us so messages are not sent to its next user.
Carriers are not liable for delayed or undelivered messages. Delivery is subject to effective transmission by your carrier and is not guaranteed. Tidal House may modify or discontinue the messaging program, but changes do not remove your right to opt out. 12. Changes and Availability
We may update the Site or these Terms, or suspend part of the Site, when reasonably necessary. Revised Terms apply from the effective date shown above. Changes do not retroactively alter a confirmed reservation’s reservation-specific terms unless permitted by those terms or law.
13. Governing Law
These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law principles. Any dispute relating solely to use of the Site will be brought in the state or federal courts with jurisdiction over Grays Harbor County, Washington, unless applicable consumer law provides otherwise.
14. General Terms
If a provision is found unenforceable, the remaining provisions remain in effect. A failure to enforce a provision is not a waiver. These Terms, together with the Privacy & Cookie Policy and any reservation-specific terms you accept, form the applicable agreement concerning the Site and reservation.
